This section provides an overview of the “Terms and Conditions” that govern the use of our platform, including individuals seeking employment and career information (“Job seekers”), employers (“Employers”), and recruitment companies (“Recruiters”). Collectively, all users are referred to as “Users,” and each individual user is an “User.” Compliance with these terms and applicable laws is the responsibility of all Users while utilizing the platform.
Definitions: The term “Sites” encompasses:

By accessing and using the Sites, Users implicitly agree to adhere to these Terms and Conditions. It’s important to note that the Company reserves the right to modify these terms without prior notice by updating this page. Users must comply with the most recent terms to continue using the platform. Violations of these terms may result in the termination of a User’s account or access.
User Responsibilities: Users bear the responsibility of fully complying with these Terms and Conditions and all relevant laws while utilizing the Sites.
Content Usage: Subject to these Terms and Conditions, the Company grants Users a non-exclusive, non-transferable, limited right to access, use, and view the Sites and the Content for personal, non-commercial purposes.
Content Definition: The term “Content” encompasses all information, content, reports, data, databases, graphics, interfaces, web pages, text, files, software, product names, company names, trademarks, logos, and trade names found on the Sites.
Restrictions: Unauthorized use of the Content may infringe copyright, trademark, and other applicable laws, including but not limited to:
(i) Removing copyright or proprietary notices from the Content
(ii) Selling, modifying, reproducing, or publicly displaying Content for commercial purposes
(iii) Using Content on any other website except for blogging and microblogging sites with proper source information credit
(iv) Transferring Content without written permission from the Company
(v) Printing or copying HTML code used to generate the Company’s pages
(vi) Interfering with the Sites’ security
(vii) Disrupting other Users’ use of the Sites
(viii) Transmitting materials negatively affecting the Sites’ functionality
(ix) Using another User’s account without prior authorization
(x) Creating a false identity on the Sites
(xi) Transmitting unsolicited mass emails
(xii) Collecting information about others, such as email/mail addresses, names, social media account information, and phone numbers, except for the stated purpose provided by the Company
(xiii) Registering an email address without the owner’s permission
Violations of system or network security may lead to legal action, involving law enforcement authorities.
Acceptable Use: Acceptable use of the Sites entails posting accurate and non-harmful Content for its stated purposes. Prohibited uses include posting modeling or talent positions, copyrighted information without permission, and sexually explicit material. Users are responsible for their actions and communications on the Sites and must comply with all applicable laws. The Company will investigate violations and may involve law enforcement authorities.
Content Truthfulness: The Company does not guarantee the truthfulness, accuracy, or reliability of User-posted content. Users submit content at their discretion, and while the Company is not obligated to screen communications, it will investigate allegations of violations. The Company reserves the right to prohibit Site use by Users who breach the Terms and Conditions.
Contact Information: For inquiries, concerns, or to report violations, Users can reach out to the Company through the provided contact information on the Sites.
Content Submission: By submitting Content to the Sites, Users grant the Company a non-exclusive right and license to use, reproduce, modify, publish, translate, distribute, communicate, or display the Content without royalties or payment. Posting Content implies the waiver of all rights to such Content.
Privacy
The Company acknowledges online privacy concerns and has established an Online Privacy Policy to address them. This policy pertains to the Sites.
Online Privacy Focus: Online privacy centers on protecting “customer identifiable” information, which includes data identifying an individual when associated with them (e.g., name, address, telephone number, email). The Company collects and uses customer identifiable information for billing, service provision, problem resolution, and informing Users of relevant job opportunities and services. This may involve sharing information among Sites to extend advertising reach.
Opt-Out: Users can opt out of receiving information at any time to cease further communications from the Company by sending opt-out request email to inquiry@jobmoose.ca. When Users access the internet, web servers automatically receive anonymous usage data, such as visited web pages. The Company’s servers collect usage data to provide targeted advertising and customized services. Usage data will not be associated with personally identifiable information without consent.
Cross-Postings: Cross-postings are possible, and Users should be aware that their postings may appear on affiliate or subsidiary websites.
Cookies: The Company and its advertisers may use various software devices, including cookies, to collect information about internet use. Users can disable cookies in their browsers, but this may affect site functionality. The Company uses cookies for identification, analytical purposes, and marketing.
Security: The Company may use customer identifiable information to investigate and prevent unlawful activity or network threats. Users may request to review and correct their customer identifiable information maintained by the Company.
Concerns: If Users have concerns about the Company’s Online Privacy Policy, they can contact the Company.
The Company’s Liability
The Company provides a platform for Employers and Recruiters to post job positions and for Job seekers to post resumes but does not screen or censor listings. The Company is a third party and is not involved in actual job transactions. Third-Party Content: The Company is not responsible for any third-party content, including job listings and user-generated content, and Users should exercise caution when interacting with such content. Users accept all associated risks, including physical harm, dealing with individuals without proper work permits, or false identities, and are encouraged to engage with other Users cautiously. Content may contain inaccuracies or typographical errors, and the Company does not guarantee its accuracy. User Responsibilities: Users are responsible for their interactions and transactions on the Sites. The Company is not an Employer and is not responsible for employment decisions made by Employers or Recruiters posting on the Sites.
NO GUARANTEE OF CONFIDENTIALITY: THERE IS NO GUARANTEE THAT PERSONAL INFORMATION AND TRANSACTIONS ON THE SITES OR THE INTERNET WILL BE MAINTAINED CONFIDENTIAL AND SECURE. THE USE OF THE SITES AND THE CONTENT IS AT THE USER’S OWN RISK, AND THE COMPANY ASSUMES NO LIABILITY OR RESPONSIBILITY REGARDING THE CONTENT, USER USE OF THE SITES, OR THE RECEIPT, STORAGE, TRANSMISSION, OR OTHER USE OF USER PERSONAL INFORMATION.
Website Warranty
Users acknowledge the potential for non-error-free operation and potential computer viruses when using the Sites. The Company is not liable for equipment or data servicing or replacement. The Sites are provided “as is” without any representations or warranties, express or implied.
Liability
IN NO EVENT WILL JOBMOOSE.CA ONLINE INC., OR ITS AFFILIATES, DIRECTORS, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, AGGRAVATED, ECONOMIC, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF USE, LOST PROFITS, OR LOST SAVINGS, EVEN IF JOBMOOSE.CA ONLINE INC. OR ANY OF ITS LAWFUL AGENTS OR EMPLOYEES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIM.
IN NO EVENT WILL JOBMOOSE.CA ONLINE INC., ITS AFFILIATES, AGENTS, LICENSORS, SUPPLIERS, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, OR EMPLOYEES, BE LIABLE FOR DAMAGES ARISING FROM VIRUSES, DATA CORRUPTION, FAILED MESSAGES, TRANSMISSION ERRORS OR PROBLEMS; TELECOMMUNICATIONS SERVICE PROVIDERS; LINKS TO THIRD-PARTY WEB SITES; THE INTERNET BACKBONE; PERSONAL INJURY; THIRD-PARTY CONTENT, PRODUCTS, OR SERVICES; DAMAGES OR LOSSES CAUSED BY THE USER, OR THE USER’S RESPECTIVE EMPLOYEES, AGENTS, OR SUBCONTRACTORS; LOSS OF USE OR LACK OF AVAILABILITY OF FACILITIES INCLUDING COMPUTER RESOURCES, ROUTERS, AND STORED DATA; THE USE OR INABILITY TO USE THE SITES OR THE CONTENT; ANY OTHER WEB SITE ACCESSED TO OR FROM THE SITES; OR EVENTS BEYOND THE REASONABLE CONTROL OF THE COMPANY, EVEN IF THE COMPANY OR ANY OF ITS LAWFUL AGENTS, OR EMPLOYEES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIM.
Termination
In case of a breach of these Terms and Conditions, the Company retains the sole discretion to remove User’s postings and communication from the Sites and terminate the User’s registration and access.
Indemnity
Users agree to defend and hold harmless JobMoose.ca Online Inc., its ownership, and employees from any claims, actions, or demands resulting from the use or misuse of the Sites, the Content, or a breach of the Terms and Conditions. The Company will promptly notify Users of any such claims or suits.
License of Use for Job Seekers
The Company offers a limited and non-exclusive right to use the Sites to seek employment opportunities for personal purposes. The platform cannot be used for commercial purposes, including sourcing job postings for other websites, social media sites, blogs/microblogs, Recruiters, or third parties, without the written consent of the Company. This excludes job postings where an Employer or Recruiter has paid to post a career opportunity and does not include other Site Content, such as articles and workplace resources. Violations may result in suspension or termination of use.
License of Use by Employers and Recruiters
The Company offers a limited and non-exclusive right to use the Sites for internal business purposes, seeking Job seekers for employment, and utilizing the Content for Company learning and development. Reproduction of the Content for commercial use, including reproduction or sale, is not permitted, except on social media sites (e.g., Facebook, Twitter, LinkedIn, Digg, WordPress, or Blogger) with proper source information credit or with written authorization from the Company. Access to the Sites, Content, or Job seekers may not be transferred to third parties without written authorization. Accessing personal information of Job seekers is limited to contacting them regarding employment opportunities. Using contact or account information for commercial purposes, including email, mail, social media, and related activities, is not allowed.
License of Use by Others
The Company offers a limited and non-exclusive right to use the Sites’ features that are not account/password protected to unclassified Users, such as journalists, economists, labor market analysts, governmental agencies, corporations, and research companies. Reproduction of the Content for commercial use, including reproduction or sale, is not permitted, except on social media sites (e.g., Facebook, Twitter, LinkedIn, Digg, WordPress, or Blogger) with proper source information credit or with written authorization from the Company. Transfer of access to the Sites, Content, or job postings to third parties requires written authorization. Violations may result in suspension or termination of use.
General Provisions
These Terms and Conditions, including any modifications, constitute the entire agreement between the User and the Company, superseding all prior understandings and agreements. If any provision is deemed unlawful, void, or unenforceable, it shall be severed, and the remaining provisions shall remain valid. These Terms and Conditions do not benefit third parties and may only be invoked or enforced by the User or the Company. The Company may assign these Terms and Conditions at its discretion. These Terms and Conditions are binding upon the User and the Company and their respective successors and assigns.
Governing Law and Jurisdiction
These Terms and Conditions, including rights and remedies, are governed by and construed in accordance with the laws of British Columbia, Canada. Any dispute arising from these Terms and Conditions is subject to the exclusive jurisdiction of the state and federal courts in the Province of British Columbia, Canada. The User and the Company consent to the personal jurisdiction of these courts, waiving objections to venue. Any cause of action related to these Terms and Conditions must be filed within one year of its occurrence.
